What Are the Grounds for Divorce in Indiana?

There are four grounds for divorce in Indiana: 

If your spouse has been convicted of a felony after getting married, if your spouse has been diagnosed with incurable insanity and hasn’t shown signs of improvement for two years; if you married your spouse and later found out they were impotent; or, if there is an irretrievable breakdown of the marriage. 

What’s the Difference Between Legal Separation and Divorce?

A legal separation is similar to divorce in that you still divide property, assets, and decide custody, visitation, spousal support, and alimony payments. You may consider legal separation over a divorce if you aren’t eligible for a divorce, if there’s a tax benefit to remaining married, or, if you oppose divorce for other reasons.

Do I Have to Go to Court for Custody?

Custody can be decided through mediation if you and your spouse are able to communicate effectively and determine the custody agreement without a judge being present. If you need a judge to decide on specific factors in the custody arrangement, going to court may be necessary.

What Is Joint Custody?

Joint custody involves both parents sharing custody and working together to make important decisions on the child’s life, whether that be medical, religious, or school decisions. Joint custody doesn’t always mean that the parents will share equal time. 

How Is Child Support Calculated?
