Vigo County Criminal Defense FAQ

Getting charged with a criminal offense can be overwhelming and leave you with a lot of unanswered questions. The legal process is foreign to most, so it’s understandable that before hiring a lawyer, you’ll want to know what you’re getting into. When you get charged with a criminal offense, it’s important to understand that you aren’t yet convicted of a crime. You have the right to fight your charge in court.

Although hiring legal representation isn’t required, a Vigo County criminal defense lawyer can significantly increase your chances of getting your charges reduced or dismissed. At Rowdy G. Williams Law Firm, our attorneys are familiar with the field of criminal law and will build a strong defense to support you. We’ll negotiate on your behalf and make sure all of your concerns are addressed.

Common Questions About Criminal Charges in Indiana

Continue reading to learn more about the process, but feel free to give us a call to answer questions that are specific to your case.

Do I Need an Attorney for a Misdemeanor?

Although a misdemeanor charge holds fewer penalties than a felony charge, hiring an attorney to fight your misdemeanor is still a wise decision. Misdemeanor penalties can range in severity from Class C to Class A, which includes fines from $500 to $5,000 and sixty days to one year in jail.

A misdemeanor charge will remain on your permanent record the same way a felony charge will and it can affect your ability to obtain a job in the future.

Can I Get a Conviction Removed From My Record?

With the second chance law in Indiana, some convictions can be removed from your record after a certain period of time, however, this period is long and shouldn’t be counted on. For misdemeanors, you’ll have to wait five years before applying for expungement, and for felonies, you’ll have to wait eight years.

The second chance law doesn’t apply if you get into any other trouble in the meantime or if the felony charges involve certain crimes, such as human trafficking or murder.
